Sponge Bob Contest Rules and Regulations

HOW TO ENTER

No purchase is necessary to enter and win. To enter the Pizza Pizza “Sponge Bob” Contest (the “Contest”), (i) go on-line to www.pizzapizza.ca then click on the kids club link, complete the online entry form, remember to correctly answer, unaided, the skill-testing question, press “submit” and you will be entered automatically, OR (ii) on a 3” x 5” piece of paper write your name, complete address, telephone number and e-mail address, not mechanically reproduced or photocopied and mail to: “Sponge Bob Contest", 580 Jarvis Street, Toronto, Ontario, M4Y 2H9. Each mailed entry must be legibly completed by hand, mailed separately, bear sufficient postage and be received no later than the last day of any Monthly Period (as defined below). Online entries must be received by 11:59 p.m. EST on the last day of any Monthly Period. Only one entry per person and/or e-mail address per each Monthly Period. Duplicate entries will not be valid and will invalidate all entries made by the entrant. Only one prize per household will be awarded. To enter, you must have one of the following web browsers: Internet Explorer 4.0 or higher, Foxfire 2.0 or higher, Netscape 4.0 or higher, AOL 4.0 or higher, or a web browser compatible with one of these browsers. All entries become the property of Pizza Pizza and none will be returned. In the event of a dispute in connection with the identity of the individual who submitted an online entry, the entry will be deemed to have been submitted by the authorized account holder of the email account identified on the online entry form. The authorized account holder is deemed to be the natural person who is assigned to an email address by an Internet access provider, service provider, or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. The personal information provided on the entry forms will be collected and used for the purposes of administering the Contest, awarding the prize and announcing the winner.

CONTEST PERIOD

The Contest runs from 10:00 a.m. EST January 1, 2009 to 11:59 p.m. EST December 31, 2009 (the “Contest Period”).

DRAW DATES

During the Contest Period, there are twelve (12) separate monthly periods, with each monthly period ending at 11:59 p.m. EST on each of January 31, 2009, February 28, 2009, March 31, 2009, April 30, 2009, May 31, 2009, June 30, 2009, July 31, 2009, August 31, 2009, September 30, 2009, October 31, 2009, November 30, 2009 and December 31, 2009 (each a “Monthly Period”). During the Contest Period, there will be twelve (12) draws, one (1) for each Monthly Period. The draws will take place at 10:00 a.m. EST on each of February 2, 2009, March 3, 2009, April 1, 2009, May 1, 2009, June 1, 2009, July 2, 2009, August 3, 2009, September 2, 2009, October 1, 2009, November 2, 2009, December 1, 2009 and January 4, 2010 (each a “Monthly Draw”). Entrants must enter only once during each Monthly Period to be eligible to win one of that month’s prize. Entries during a particular Monthly Period do not qualify for prizes in subsequent Monthly Periods.

HOW TO WIN

At or on each Monthly Draw date, five (5) entrants will be randomly selected from all eligible entries received during each Monthly Period. Any selected mail-in entry forms must be legible and fully completed. All selected entrants must correctly answer a mathematical skill-testing question without assistance or the use of a calculator. The selected entrants will be notified by email and/or telephone within 3 days of the Monthly Draw date and may be required to provide proof of identification. In the event that any email notification is returned as undelivered, a further three (3) attempts will be made to re-send said email. If a selected entrant does not respond to the email notification within three (3) days, the prize will be forfeited and an alternate entrant will be selected from among all eligible entries received during the applicable Monthly Period. In the event that a selected entrant is contacted by telephone instead of email and his/her request, and does not respond to the telephone notification within three (3) days, the prize will be forfeited and an alternate entrant will be selected from among all eligible entries received during the applicable Monthly Period. Alternate entrant(s) will be selected in the same manner as the original selected entrant. It is the sole responsibility of the entrant to notify Pizza Pizza in writing if the entrant changes his or her email address. To do so, send an email to contests@pizzapizza.ca.

Before being declared a winner, selected entrants must: (i) correctly answer a time-limited mathematical skill-testing question without assistance or the use of a calculator, administered at the time of contact, and (ii) sign (or, where the selected entrant is a minor in his/her province of residence, his/her parent or legal guardian must sign) a Declaration of Compliance with the Contest rules and a Release of Liability releasing Pizza Pizza, the contest judging organization, the prize suppliers, Viacom International Inc., their respective advertising and promotional agencies and each of their respective directors, officers, owners, partners, employees, agents, franchisees, subsidiaries, affiliates, associated companies, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest or the acceptance or use of any prize awarded in this Contest. The Declaration and Release document must be returned on or before the date indicated on the documents or the prize will be forfeited.
Winners from each Monthly Period will be announced on-line at the end of the following Monthly Period at www.pizzapizza.ca.

GENERAL RULES

1. The Contest is open to all Ontario residents ages 6 to 12. Employees of Pizza Pizza Limited and its franchisees and the immediate family members of, or those domiciled with, an employee of Pizza Pizza Limited and its franchisees, their agents and representatives, their parents, affiliates, subsidiaries and dealers, advertising and promotional agencies, as well as suppliers of materials or services related to this contest, including the independent contest organization Pizza Pizza Limited, are not eligible to enter the contest. “Immediate family members” are defined as parents, siblings, children or spouse.
2. All decisions made by the contest judges with respect to this Contest are final and binding.
3. Chances of winning for each Monthly Draw will vary depending upon the number of eligible entries received during each Monthly Period.
4. Each prize must be accepted as awarded and no prize substitutions of cash or otherwise or transfer of the prize will be made, provided that Pizza Pizza may make prize substitutions of equal or greater value in their sole discretion for any reason whatsoever.
5. In the event that the winner is unable to redeem any or all of the prize components due to reasons beyond the control of the Releasees, no compensation or substitution prize will be provided. Prizes will be delivered to the winner via Canada Post.
6. The Releasees are not responsible for any problems, failure or technical malfunctions of Canada Post, any telephone system, Internet connection or equipment, computer on-line systems, servers, computer equipment or software which results in lost, stolen, illegible, incomplete, misdirected, altered, late or destroyed entries or winner notifications.
7. The Releasees are not responsible for any printing, distribution or production errors and may terminate or withdraw this Contest for any reason, without notice and without liability, at their sole discretion. In all instances, the Releasees shall have no obligation to distribute more prizes than as indicated in the Rules. Any decision or ruling by Contest Sponsor in this regard is final and without appeal.
8. By redeeming their prizes, entrants agree to release the Releasees from any and all liability, including loss or damage, directly or indirectly related, in whole or in part, to the acceptance, possession, use or misuse of the prizes or participation in this Contest. To the maximum extent permitted by law, acceptance of the prize by any winner shall be as-is, where-is, without any warranty or condition whatsoever from the Releasees, including, without limitation, express or implied warranties or conditions of any kind with respect to safety, appearance or performance of any prize or prize activity offered, any warranty or condition of merchantability or suitability for a particular or general purpose, or any warranty or condition that the prize is without defects or hidden vices, and such acceptance shall constitute an agreement by the winner to look solely to the manufacturer and the warranties and conditions provided by it, if any, should any defects in the prize exist.
9. By claiming a prize in the Contest, each winner consents (or, where the winner is a minor in his/her province of residence, his/her parent or legal guardian consents on the minor’s behalf) to the use of the winner’s name, image, photograph, voice statement(s) and city of residence, without further compensation, for any and all publicity purposes, commercial or otherwise, in any form of media used by the Contest Sponsors.
10. The Contest is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited by law. Contest Sponsor may withdraw, amend or terminate this Contest at any time for any reason without prior notice but subject to applicable law.
11. By entering the Contest, entrants agree (or, where the entrant is a minor in his/her province of residence, his/her parent or legal guardian agrees on such minor’s behalf) to be bound by these rules and regulations and all decisions of the Contest Sponsor.
12. Any cost or expense (including, without limitation, any applicable taxes) which are incurred by a winner or potential winner of any prize, whether in claiming or using such prize, or any part of such prize, or otherwise (except as detailed in the prize description), is the sole responsibility of the winner or potential winner of the prize.
13. The following are prohibited and will result in automatic disqualification from the Contest: (1) entering the Contest more than once per monthly period; (2) using any method that artificially increases odds of winning; (3) non-compliance with these Rules; and (4) any other act which the Contest Sponsor determines, at its sole discretion, jeopardizes the integrity of the Contest.
14. Any action which, in the sole opinion of the Contest Sponsor, represents an attempt a) to tamper with the Contest entry process, b) to interfere with the operation of the Contest or with the enforcement or functioning of these rules, c) to damage the Pizza Pizza Website or d) to undermine or corrupt the fair and proper administration, security or legitimate operation of the Contest, may be in violation of criminal and civil laws, and the Contest Sponsor reserves the right to seek damages and/or other relief from any and all persons responsible for any such actions or attempts to the fullest extent permitted by law, and to ban or disqualify persons from entering the Contest and any future contests or promotions of the Contest Sponsor.
15. Unless entrants otherwise consent, the personal information gathered about them in the course of this Contest will be collected and used solely by the Contest Sponsor and their authorized agents for the administration of this Contest and prize fulfillment.
